CIUDAD DE M\u00c9XICO.\u2014 Con el argumento de que el transporte p\u00fablico es un espacio donde convergen riesgos sistem\u00e1ticos para millones de usuarios, el senador mexiquense Enrique Vargas del Villar present\u00f3 una iniciativa para endurecer las penas contra quienes cometan robos, abuso sexual o violencia en unidades y espacios vinculados al servicio concesionado.<\/p>\n\n\n\n

La propuesta, suscrita por el vicecoordinador del Grupo Parlamentario del Partido Acci\u00f3n Nacional en el Senado, plantea reformar y adicionar disposiciones del C\u00f3digo Penal Federal. El objetivo es establecer agravantes espec\u00edficas cuando los delitos se perpetren dentro de autobuses, combis, taxis, estaciones, paradas o terminales.<\/p>\n\n\n\n

De acuerdo con el legislador, la exposici\u00f3n cotidiana de pasajeros \u2014en particular mujeres, j\u00f3venes y personas mayores\u2014 a situaciones de riesgo obliga a reconocer el car\u00e1cter agravado de estas conductas. \u201cLa exposici\u00f3n diaria de las y los pasajeros al riesgo de ser v\u00edctimas de delitos hace indispensable elevar las penas cuando dichos delitos se cometan en el transporte p\u00fablico y\/o concesionado\u201d, sostuvo.<\/p>\n\n\n\n

La iniciativa contempla adicionar la fracci\u00f3n VI al Art\u00edculo 266 Bis para que las sanciones por abuso sexual y violaci\u00f3n aumenten hasta en una mitad tanto en su m\u00ednimo como en su m\u00e1ximo, cuando estos il\u00edcitos ocurran en espacios del transporte p\u00fablico o concesionado. Asimismo, propone reformar el Art\u00edculo 376 Ter para sancionar con mayor severidad el robo cometido contra usuarios o prestadores del servicio.<\/p>\n\n\n\n

Las cifras que respaldan la propuesta muestran un contexto adverso. Seg\u00fan la Encuesta de Seguridad P\u00fablica Urbana (ENSU), 70.9 por ciento de las mujeres manifest\u00f3 sentirse insegura al utilizar transporte p\u00fablico. El Instituto Nacional de las Mujeres reporta que nueve de cada diez han sufrido agresiones verbales, persecuci\u00f3n, acoso o abuso sexual en estas unidades.<\/p>\n\n\n\n

A ello se suma que la Encuesta Nacional de Victimizaci\u00f3n y Percepci\u00f3n sobre Seguridad P\u00fablica (Envipe) 2025 se\u00f1ala que 23.7 por ciento de las personas dej\u00f3 de usar transporte p\u00fablico por temor a ser v\u00edctima de un delito y 36.7 por ciento evita tomar taxis por considerarlos inseguros. En el Estado de M\u00e9xico, durante el a\u00f1o pasado se registraron cinco mil 103 robos a bordo de unidades concesionadas.<\/p>\n\n\n\n

Vargas del Villar argument\u00f3 que, aunque el C\u00f3digo Penal Federal ya tipifica robo, abuso sexual y violencia, no prev\u00e9 agravantes suficientes para delitos cometidos en transporte p\u00fablico, pese a que afectan la libertad de tr\u00e1nsito y derechos fundamentales. La reforma busca cerrar ese vac\u00edo legal y reforzar la protecci\u00f3n de quienes utilizan diariamente este servicio esencial.<\/p>\n\n\n\n
