Bajo ese contexto, el senador por el Estado de M\u00e9xico, Enrique Vargas del Villar, plante\u00f3 cerrar de forma definitiva la puerta al cobro de la tenencia vehicular en todo el territorio nacional.<\/strong><\/p>\n\n\n\n<p><strong>El vicecoordinador del Grupo Parlamentario del PAN en el Senado suscribi\u00f3 una iniciativa para reformar la Ley de Coordinaci\u00f3n Fiscal y a\u00f1adir el art\u00edculo 10-F, con el prop\u00f3sito de impedir que entidades federativas, municipios o alcald\u00edas de la Ciudad de M\u00e9xico puedan establecer, mantener o recaudar contribuciones, impuestos, derechos o aprovechamientos que graven la tenencia, uso o posesi\u00f3n de veh\u00edculos particulares, sin importar la denominaci\u00f3n o el mecanismo de c\u00e1lculo.<\/strong><\/p>\n\n\n\n<p><strong>Aunque el impuesto federal sobre la tenencia fue eliminado en 2012, Vargas del Villar se\u00f1al\u00f3 que la falta de una prohibici\u00f3n expresa dentro del Sistema Nacional de Coordinaci\u00f3n Fiscal permiti\u00f3 que diversos estados conservaran o reconfiguraran el cobro bajo esquemas alternos, como impuestos \u201cverdes\u201d, derechos de control vehicular o figuras vinculadas a la posesi\u00f3n del autom\u00f3vil.<\/strong><\/p>\n\n\n\n<p><strong>El legislador argument\u00f3 que este gravamen perdi\u00f3 sustento jur\u00eddico, econ\u00f3mico y social, al convertirse en una carga directa sobre el patrimonio familiar. Record\u00f3 que la tenencia fue creada en 1962 con car\u00e1cter excepcional para financiar los Juegos Ol\u00edmpicos de 1968, pero su permanencia se extendi\u00f3 por d\u00e9cadas m\u00e1s all\u00e1 de su objetivo original.<\/strong><\/p>\n\n\n\n<p><strong>En t\u00e9rminos financieros, cit\u00f3 datos de la Secretar\u00eda de Hacienda y Cr\u00e9dito P\u00fablico que indican que los ingresos por tenencia representan, en promedio, menos del uno por ciento de los ingresos totales de las entidades federativas. A su juicio, el impacto recaudatorio es marginal frente a las distorsiones que genera, entre ellas el cambio de placas hacia otras entidades, la evasi\u00f3n fiscal y el crecimiento de la informalidad.<\/strong><\/p>\n\n\n\n<p><strong>Adem\u00e1s, sostuvo que la ambig\u00fcedad normativa vigente contraviene el principio de certeza jur\u00eddica previsto en los art\u00edculos 14 y 16 de la Constituci\u00f3n, as\u00ed como el principio de proporcionalidad tributaria establecido en el art\u00edculo 31, fracci\u00f3n IV.
